1. Terms of Use

The use of this website is subject to the following terms of use:

1.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice.

1.2 By entering your details on this website either as part of a sale, to contact us or subscribe to email lists, you confirm that you agree to our Privacy Policy.

1.3 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

1.4 Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

1.9 Your use of this website and any dispute arising out of such use of the website is subject to the laws of Northern Ireland, England, Scotland and Wales.

2. Conditions of Sale

2.1 These Conditions shall apply to all contracts for the sale of Goods by HEMPTATIONS CBD to the Buyer. Additionally to the exclusion of all other terms and conditions including any terms or conditions. This extends to those which the Buyer may purport to apply under any purchase order confirmation of order or similar document. These conditions will prevail over any other information supplied to the Buyer or displayed on our website.

2.2 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions.

2.3 The contract for sale of the Goods shall not be concluded until HEMPTATIONS CBD has confirmed the order to the Buyer either by email, phone or fax.

2.4 Acceptance of delivery/collection of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these conditions.

2.5 Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by HEMPTATIONS CBD.

3. The Price and Payment

3.1 The price shall be the price set out in the order for the Goods.

3.2 Payment of the Price shall be due with the order.

3.3 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). We reserve the right to alter all product pricing without notice.

3.4 All prices exclude VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT.

3.5 Payment can be made by Visa and Mastercard. These payments will be processed by Total Processing. You may also make payment by bank transfer. In this instance you will be presented with our bank details by email after ordering having selected this payment option. Please use your order number as payment reference. In addition to these payment options you may also pay with Bitcoin. Finally customers in Northern Ireland can pay for their order by cash, credit or debit card upon collection. Please contact us for further information.

3.6 We may refuse in our discretion to accept an order: (i) Where we cannot obtain authorisation for your payment(ii) If there has been a pricing or product description error(iii) If you do not meet any eligibility criteria set out in our terms and conditions(iv) Where goods ordered by you are not available(v) If we do not deliver to your area In the event that we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment. 

3.7 Cashflows

Credit and debit card payments are processed securely by Cashflows. Using Cashflows allows us to securely accept payments online while keeping us and our customers protected at all times. Every transaction powered by Cashflows happens in an encrypted, secure environment – from transmission, to processing, to storage.

In addition, you know that your session is in a secure encrypted environment when you see https:// in the web address, and/or when you see the locked padlock symbol alongside the URL, so when buying through our site, you can be sure that you are completely protected. 

3.8 Coinbase Commerce

 If you wish to pay for your order using cryptocurrency you can do so securely thanks to Coinbase Commerce. We currently accept Bitcoin. Please note that this option is currently only available upon request. Please get in touch with us in advance of your order if you wish to pay for your online order this way. Payments in store can be facilitated at any time.

3.9 Fena

You can now pay for your order using Fena. Fena are a fintech company who are using Open Banking to easily and securely let you pay for your order directly from your online banking. In other words an easy and safe way to do a faster payment or a bank transfer.

4. The Goods

 4.1 The quality and description of the Goods shall be as set out in the Order. We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. If there is anything which you do not understand, or if you wish to obtain further information, please contact our Customer Services team at [email protected].

4.2 HEMPTATIONS CBD may from time to time make changes in the specification of the Goods which are required to comply with any applicable safety or statutory requirements or which do not materially affect the quality or fitness for purpose of the Goods. Also, HEMPTATIONS CBD does not warrant that the colour of the Goods will exactly match the colour shown on the website.

5. Eligibility

5.1 This Site and any products sold on this Site are intended for use by persons 18 years of age and over.

6. Warranties and Liability

6.1 HEMPTATIONS CBD warrants that the Goods will at the time of delivery/collection correspond to the description given by the Seller (subject to the terms of clause 4.2).

6.2 Products purchased via this Site must only be used in accordance with the instructions provided with the products and/or on this Site. HEMPTATIONS CBD accepts no responsibility for damage, loss or injury caused by improper use of the products sold.

7. Privacy Policy

7.1 The company respects the privacy of its service users. Please refer to the Company Privacy Policy which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the service, you signify your agreement to the Privacy Policy as well as these Terms and Conditions.

8. Returns

8.1 Should you change your mind about an item you have purchased from HEMPTATIONS CBD, you have 14 calendar days from the day after the item is received to let us know you would like to return the item for a refund. Please return the item to us within 14 days in unopened/unused condition and we will issue a full refund. Please allow up to 14 days to receive the refund.

8.2 Items that are faulty or damaged on delivery must be reported to HEMPTATIONS CBD within 14 days of receipt.

8.3 Items that have been dispatched incorrectly by HEMPTATIONS CBD will be replaced and a prepaid returns label issued to return incorrectly sent items. You will be sent a link to print off a returns label. If the items you are returning exceed the accepted weight/size, please contact us to organise a courier collection.

9. Delivery of Goods

9.1 We offer a number of delivery options which you can learn about on our delivery page. All orders are sent with Royal Mail, except where we deem delivery by alternative provider necessary. Your order may require a signature upon delivery. If you are not available to accept an order, the standard terms of Royal Mail deliveries will apply. This will typically involve a card being left to inform you that your order has been delivered to a local post office for collection.

9.2 We process your order as soon as possible and endeavour to do this the same day when received before 4:00pm Monday to Friday. Orders received between 4:00pm Friday & midnight Sunday will be dispatched on the following Monday. On rare occasions, an item may be out of stock or unavailable and can take longer than the stated delivery time. In this case we will attempt to contact you to inform you of delays. We are unable to give exact delivery dates except where Next Day delivery services have been purchased within the correct terms and in which case the liability will then fall with Royal Mail who provide the service.

9.3 The majority of orders will be shipped via Royal Mail. Once the items have been dispatched from us we hold no liability for damage, loss or delay. If Next Day delivery has been paid for then we will put in a claim for any damage, loss or delay for you.

9.4 Although we will make every effort to verify and address with Royal Mail prior to dispatch where necessary, we accept no liability if incorrect address details given with your order lead to loss, delay or non-delivery. Please ensure you provide the correct details when ordering.

9.5 You may contact us to request dispatch of your order at a later date and we will endeavour to meet your requirements.

9.6 Please allow 5 working days for delivery before contacting us to advise your order has not arrived. Take a look at our delivery page for further information.

9.7 If the value of your order is above £50, you will likely be asked to sign for the goods received. If the package does not appear to be in good condition or items have been damaged, please contact us as soon as possible so that we can put in a claim with the delivery provider.

9.8 Please open all boxes or parcels as soon as they arrive, you have 14 days to notify HEMPTATIONS CBD of any damage, shortages or incorrect items seemingly not caused by delivery. If we are not notified of damage, shortages or incorrect items within this time, you agree to indemnify HEMPTATIONS CBD in full against any losses we suffer as a result of your failure to notify us within 14 days.

9.9 We deliver across the UK and to the Republic of Ireland. Delivery to areas outside of these areas may be possible therefore please contact [email protected] for delivery information.

10. Acceptance of Goods

10.1 The Buyer shall be deemed to have accepted Goods 24 hours after collection or delivery to the Buyer (unless the Buyer is a Buyer defined in condition 11). 10.2 After acceptance the Buyer shall not be entitled to reject Goods which are not in accordance with the contract.

11. Title and Risk

11.1 Title shall pass on delivery/collection of the Goods. 11.2 Risk shall pass on delivery/collection of the Goods.

12. Remedies of the Buyer

12.1 Where the Buyer rejects any Goods (where the Buyer is entitled to reject the Goods) the Buyer shall have no further rights whatsoever in respect of the supply to the Buyer of such Goods or the failure by HEMPTATIONS CBD to supply Goods which conform to the contract of sale.

12.2 Where the Buyer accepts or has been deemed to have accepted any Goods then HEMPTATIONS CBD shall have no liability to the Buyer in respect of those Goods.

12.3 HEMPTATIONS CBD shall not be liable to the Buyer for late delivery of the Goods.

12.4 HEMPTATIONS CBD shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by HEMPTATIONS CBD of this contract.

12.5 In the event of any breach of this contract by HEMPTATIONS CBD the remedies of the Buyer shall be limited to damages. Under no circumstances shall the liability of HEMPTATIONS CBD exceed the Price of the Goods.

13. Supply of Goods Only

13.1 The Buyer acknowledges that HEMPTATIONS CBD is simply a supplier of Goods and any application of the Goods is the sole responsibility of the Buyer.

14. Right to Cancellation

14.1 The following cancellation terms apply under the Consumer Contracts Regulations 2014. These regulations apply to contracts of sale entered into on or after 13th June 2014.

14.2 Should you wish to cancel your contract of sale with HEMPTATIONS CBD, you have 14 days from the day after you receive the Goods to inform us of your decision to cancel. You should contact us by email at [email protected] or by phone on 02891461955 for return instructions. You then have a further 14 days within which to return the goods to us in their original unopened, unused condition.

14.3 In the event of cancelling the contact, you, the Buyer, will be liable for paying the costs of returning the goods to us and must obtain proof of postage.

14.4 On receipt of the returned Goods and provided they are in an opened, unused condition, you will be refunded the full value of the order, including basic postage charges, less any costs incurred for recovering the goods should these apply. Your refund will be issued within 14 days of receiving the returned Goods. 14.4 Where you have purchased additional delivery services (e.g. Next Day delivery), the additional delivery costs will not be refunded.

15. Complaints

15.1 To ensure that complaints can be investigated and resolved quickly and satisfactorily, HEMPTATIONS CBD has a clearly defined procedure for managing customer complaints. Details of this procedure, and what you should do if you would like to make a complaint, are specified below:

A member of our customer service team will investigate and endeavour to resolve the complaint in a fair, timely and efficient manner and where possible, at the first point of contact. In most cases, no further action should be necessary. However, should a member of the customer service team be unable to resolve the complaint, it will be escalated to a senior member of staff who will respond to you within 5 working days.

Customers who are not satisfied with the resolution or explanation provided may then make a formal written complaint to the Managing Director who will respond within 10 working days of receipt. In the event that all the above procedures have been followed and completed without eliciting an acceptable response or proposed resolution, you can raise a dispute via the EU Online Dispute Resolution platform.

16. Proper Law of Contract

16.1 Sales on this website are governed by Northern Irish law and you agree to submit any dispute to the non-exclusive jurisdiction of the Northern Ireland courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights. 16.2 These terms and conditions only cover the HEMPTATIONS CBD web site (https://www.hemptations-cbd.com). Any other web sites to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of web sites which are not under our control.

17. Store Loyalty Scheme (in Store)

By participating in HEMPTATIONS CBD store Loyalty Rewards scheme, you agree to be bound by the following terms & conditions.

17.1 Loyalty discounts or stamps have no monetary value. Any value accrued from the collection of loyalty stamps is not considered actual currency and may only be applied to orders placed in store, where other terms and conditions are met, and where no exclusions apply.

17.2 Stamps cannot be allocated to other accounts or users

17.3 Loyalty discounts may not be applied with other coupons or discounts

17.4 We reserve the right to change the terms of our loyalty scheme at any time. We will contact customers by email to inform them of any changes at least 2 working days prior to them taking effect.

17.5 We reserve the right to change or amend the value of HEMPTATIONS CBD loyalty points and number of points allocated for actions at any time.

17.6 One stamp will be awarded for each item with a value over £10 purchased. Accrue 5 stamps and receive 20% off your fifth eligible product purchase.

17.7 Stamps are awarded for full priced items over £10 only.

17.8 No stamps will be awarded on sale items or drinks.

17.9 In the event you purchase multiple products when redeeming your loyalty stamps discount will be applied to the lowest priced item.

18. CBD Rewards Program (Online)

By participating in HEMPTATIONS CBD Rewards Program, you agree to be bound by the following terms & conditions.

18.1 Reward points also have no monetary value. Any value accrued from the collection of points is not considered actual currency and may only be applied to orders placed on our website, where other terms and conditions are met, and where no exclusions apply.

18.2 Reward points cannot be allocated to other accounts or users.

18.3 Redeemed reward discount coupons may not be applied along with other coupons or discounts.

18.4 We reserve the right to change the terms of our CBD Rewards Program at any time. We will contact customers by email to inform them of any changes at least 2 working days prior to them taking effect.

18.5 We reserve the right to change or amend the value of HEMPTATIONS CBD reward points and number of points allocated for actions at any time.

18.6 Points can be accrued by creating an account on our website, purchasing products, commenting on our blog posts or by leaving product reviews.

18.7 A minimum of 1000 points must be accrued before you can redeem your points for a coupon.

18.8 Unused loyalty points will expire after 730 days of inactivity. Therefore make sure to earn or redeem points intermittently to keep your points active.

18.9 Any coupons created when redeeming points will expire if unused within 365 days.
